The State Board of Elections and Ethics Enforcement has lost another round in its court battle with a company that produces an electronic pollbook.

In an unpublished opinion with limited precedential value, a unanimous three-judge panel dismissed the state board’s attempt to end a preliminary injunction. The injunction blocks the board from banning VR Systems‘ EViD e-pollbook from 2018 elections.

Some N.C. counties have used EViD since 2009. It last had an endorsement from the state elections board in 2016. But the board revoked its certification for EViD in June 2017. The court fight has involved the state board’s attempt to enforce that June 2017 decision. Courts have sided with VR Systems at each stage in the court battle.
