A three-judge panel of the N.C. Court of Appeals has reversed a lower court and thrown out a challenge of North Carolina’s restaurant smoking ban from Pitt County for-profit club owners.

In other opinions released this morning:

  • A unanimous three-judge panel affirmed a lower court ruling throwing out a suit from Appalachian State University professors challenging the state’s right to dock their pay by 0.5 percent in 2008-09 because of budget cuts. Appellate judges agreed with the trial court that the case was moot. “[P]laintiffs have presented only an academic question, and this Court’s ruling upon plaintiffs’ complaint would have no practical effect.”
  • A unanimous three-judge panel affirmed a lower court and ruled against Durham County, the county sheriff’s department, and a deputy who sought to have a negligence lawsuit thrown out in connection with a 2010 car crash in which the plaintiff was injured.
  •  A unanimous three-judge panel reversed the Disciplinary Hearing Commission and threw out the disbarment of an attorney involved in a dispute linked to a residential real estate closing.
