Just imagine the benefits that would accrue to healthcare consumers if these Wake County hospitals were spending their time, effort, and money competing against each other for customers, rather than competing against outdated state regulations.

State regulators this afternoon awarded 41 new hospital beds to WakeMed and four new operating rooms to Orthopaedic Surgery Center of Raleigh, a partnership that includes Rex Hospital.

But today’s ruling is likely to kick off a lengthy legal fight among the three applicants that vied for the hospital bed allocation.

The culprit is the state’s Certifcate of Need law – known as CON. Locke Foundation Vice President for Research, Roy Cordato, destroys arguments for the CON law in this policy report.
