A unanimous three-judge panel of the N.C. Court of Appeals has ordered a new trial in a funding dispute involving the Union County commissioners and school board. The decision throws out a trial court ruling ordering county commissioners to appropriate nearly $5 million more for Union County schools for 2013-14 current operating expenses, along with $86 million more for capital expenses.
Among other opinions released this morning:
- A three-judge panel offered a mixed ruling that upholds Mecklenburg County Sheriff Daniel Bailey’s firing of two employees after the 2010 election. Both employees had claimed political retaliation from the Democratic sheriff because they are Republicans who did not contribute to or support his campaign. All three members of the appellate panel agreed that one of the fired employees did not have a good case. The judges split, 2-1, on the other employee’s case.
- A unanimous three-judge panel vacated an administrative law judge’s ruling in a battle involving five different providers fighting for certificates of need for new nursing facility beds in Wake County.
- A unanimous three-judge panel affirmed a lower court ruling favoring CarolinaEast Medical Center in Craven County in a dispute involving a patient’s death in 2011.
- A three-judge panel agreed to affirm a ruling against Davidson County in a property evaluation dispute involving two textile manufacturing plants.
