A unanimous three-judge panel of the N.C. Court of Appeals has affirmed a trial court’s ruling against Duke Energy in an easement case pitting Duke against a Huntersville homeowner. Appellate judges agreed with the trial court that Duke Energy had failed to file suit within the six year statute of limitations applicable in the case.

Among other opinions the Court of Appeals released this morning:

  • A unanimous three-judge panel reversed the N.C. Industrial Commission and ruled that a Charlotte cab driver was an independent contractor and not an employee eligible for worker’s compensation in connection with injuries suffered when a passenger shot him in 2011.
  • A unanimous three-judge panel affirmed a trial court’s ruling to dismiss a lawsuit involving contributory negligence claims against Davie County grandparents in the 2011 drunken driving death of their 19-year-old grandson.
  • A unanimous three-judge panel affirmed a trial court ruling against a surgeon suing the Maria Parham Medical Center in Henderson.
  • In an unpublished opinion with limited precedential value, a unanimous three-judge panel affirmed a trial court’s ruling against the N.C. state auditor’s office in a dispute with a longtime employee who contends he was dismissed improperly.
