In an unpublished opinion with little precedential value, a unanimous three-judge panel of the N.C. Court of Appeals has sent back to trial a case involving John Cashion, the former president and CEO of Davidson Health Care and Lexington Memorial Hospital. Cashion and his former employer have been fighting in court over the terms of his departure. Appellate judges agreed that some issues in the case should be decided by a jury and reversed earlier trial court rulings favoring both the plaintiff and defendant.

Among other unpublished opinions, a unanimous three-judge panel affirmed an earlier ruling in a certificate-of-need case awarding 28 new acute-care hospital beds to FirstHealth Moore Regional Hospital instead of Cape Fear Valley Health System.
