A unanimous three-judge panel of the N.C. Court of Appeals reversed a Wake County trial judge this morning and ruled against Housecalls Home Healthcare in its long-running legal battle with the N.C. Department of Health and Human Services linked to a Medicaid fraud investigation.
Among the other new opinions released this morning from the N.C. Court of Appeals:
- A unanimous three-judge panel reversed a lower-court ruling in a Rowan County criminal case involving a man convicted of both statutory rape and second-degree rape for the same offense. Appellate judges ruled the defendant was represented ineffectively by his attorney, who failed to object when the trial judge sentenced the man in connection with both charges. The case heads back to the trial-court level for the defendant to face sentencing on just one of those convictions.
- A unanimous three-judge panel affirmed a lower-court ruling favoring Pinehurst in a dispute over construction on the town’s Village Green.
- A unanimous three-judge panel affirmed a lower-court ruling from Montgomery County favoring the Badin Shores Resort Homeowners Association in a dispute over a sewer service contract.
